In 2016 the National Justice Project acted for a young African woman who had been raped on Nauru during or immediately after a seizure. She had been transported to PNG for a termination which she alleged was neither safe nor legal in PNG.

The Federal Court decided that the Australian Government owed the woman known as S99 a duty of care and agreed with S99 that the procedure could not go ahead on Nauru as it would be a breach of the minister's duty of care.

The National Justice Project focuses on strategically important cases like S99 vs the Minister for Immigration and Border Protection which extended the protection of Australian tort law to an offshore refugee for the first time.
